TERMS AND CONDITIONS
GENERAL:
1. The Contest “KRICKET KA KARIZMA” (hereinafter referred to as the “Contest”) is an online and mobile gaming contest promoted by Hero Honda Motors Ltd (hereinafter referred to as “HERO HONDA”). The game may be accessed and played by individuals on mobile phones and internet. The game may be played or downloaded by anyone, however, only those individuals who fulfill the qualifying criteria i.e. Indian citizens residing in India above 18 years of age, shall be entitled to the prizes or any other benefits as specified herein (“Select Participants”).
2. The Select Participants shall have to register themselves online at www.kricketkakarizma.com in the manner as specified herein below. Thereafter, the Select Participants shall play the game and the scores of the Select Participants playing on PC and mobile phone shall then be integrated and 11 Winners shall be selected, who shall be entitled to prizes specified hereunder.
3. The decision of HERO HONDA shall be final and binding in all matters relating to this event and no correspondences will be entertained. HERO HONDA reserves the right to change these terms and conditions without prior notice. A participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the game micro-site and shall be deemed to have accepted such amendments or interpretations by virtue of his / her continued participation in the event. Should a participant not wish to continue to participate in the event pursuant to the prevailing terms and conditions as amended or interpreted, he / she may terminate participation in the event upon written notice to HERO HONDA.
4. The Contest is open for participation from 17th February 2011 till 12 midnight on 20th March, 2011 [hereinafter referred to as “The Contest Period”] in cities and towns across India only.
5. This Contest cannot be clubbed with any other offer or Contest.
6. HERO HONDA reserves the right to revise or amend any/all the terms of the Contest at its sole discretion without any prior intimation to the Select Participants and/or the general public or it may withdraw this Contest at any time without assigning any reason whatsoever, and if it chooses to do so, the Contest will stand cancelled and no participant will be entitled to receive any prizes.
QUALIFYING ENTRIES:
7. The Contest is open to all Indian Citizens residing in India having a valid Indian mobile number along with a valid proof of identity and address which could be any one of the following three viz. Passport/Voter’s ID/Driving License.
8. The participant needs to be of minimum 18 years of age at the time of participating in the contest. The participant must have a valid age proof i.e. Date of birth certificate from the school last attended by the applicant or any other recognized educational institution; or an Affidavit sworn before a Magistrate/ Notary stating date/place of birth as per the specimen in ANNEXURE ‘A’ by illiterate or semi-illiterate applicants.
9. HERO HONDA may, in its sole discretion, disqualify all entries from, and prohibit further participation in this event by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the event or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person or is unable to provide valid proofs of age, identity and address, as specified above. Participants who enter incorrect registration details will also be disqualified.
10. All associates, partners, vendors, employees, their families and relatives of Hero Honda are not eligible for the participation in the contest.
REGISTERING FOR THE CONTEST
11. Any person, who qualifies the criteria as specified above, may participate in the Contest by playing the game online or by downloading the game on his/her mobile phone.
12. For participating in this contest, over both Internet and mobile, the participant should have requisite technical specification over the Mobile and PC along with the data connection. There is no charges/fee for registering or downloading or playing the game. However normal access charges apply as per the Telecom / Service provider.
13. Following steps may be followed to register and play the game online on PC:
1. For playing the game online, the participant needs to log on to http://www.kricketkakarizma.com.
2. The Participant will be asked to submit his/her mobile number and date of birth. only those participants having a valid Indian mobile number and are above 18 (Eighteen) years of age, shall be able to proceed further and shall qualify as Select Participant.
3. The Select Participant will then receive a special code on the mobile phone number entered by him/her.
4. The browser will be automatically redirected to the registration page where the Select Participant will be asked to enter his/her name, email, place of residence (City) and the special code received on the mobile phone. This will complete the registration.
5. Once successfully registered, the Select Participant will be able to play the game online through the browser on his/her personal computers.
14. Following steps can be followed to register and play the game on a mobile phone:
1. A participant needs to type “KKK” and send SMS to 56161 to receive a link to the registration page. For all such SMS, premium SMS charges will be borne by the participant as applied by his/her network operator.
2. The participant then needs to login using the link and enter his/her details including name, email, place of residence (City), mobile number and date of birth.
3. The Select Participant then needs to accept terms and conditions; and proceed to download the game on the mobile handset. It is hereby clarified that only those participants having a valid Indian mobile number and are above 18 (Eighteen) years of age, shall be able to proceed further and shall qualify as Select Participant.
4. While downloading the game if the server gets down or connection gets disconnected due to any network problem than the Select Participant playing game on mobile shall have to download the game again by following the aforesaid steps.
5. Alternately the participant can enter his / her mobile number on http://www.kricketkakarizma.com and follow the steps mentioned above.
6. Another way for playing game on mobile is by going to http://m.kricketkakarizma.com through the mobile browser. User will register and accept terms and conditions to download the game.
7. Mobile game is available for only select handsets. Please check the compatibility of your handset at http://m.kricketkakarizma.com/handsets.
8. Iphones and Android will not support this game.
HOW TO PLAY
15. ‘How to Play’ and the criteria for selection of the winners is available under rules link on http://www.kricketkakarizma.com/rules. Player can choose his own team and opponent team, post that he/she has an option to select and swap any player from the set of reserve players and create his final set of players who will be playing for that match. Opponent team players will be automatically selected by the game engine. The player can decide to bat or ball first. The game consists of five over match on each side. To play the game, the participant will require to use his/her skills on the PC keyboard or the mobile keypad. Once the game starts over the internet, the participant cannot abandon the game in between. If he/she logs out or there is a session timeout, then the particular match is considered abandoned and the score for the particular match will not be counted. While playing on mobile the participant has an option to pause and resume the game which can be done manually also or upon some events as incoming call or sms. When playing on the mobile phone, at the end of the game the Select Participant shall be required to send in his/her score to the server. For sending the score, standard SMS tariff will be applied as per his/her network operator. The SMS charges shall be applied every time a Select Participant shares the scores with the server. Participants should read through “How to Play” section in the main menu of the game.
SCORING
16. The overall score will dependent upon the selection of the opponent team and will be calculated as: Match Result Points X Weightage allocated to the Opponent Team. Please check the weightage (team strength) before selecting the opponent team. Match Result Points are allotted on the basis of any of the three outcomes of the match i.e. WIN = 3, Tie = 1 and Loose = 0. All the teams would carry a certain weightage based on a popular International Ranking Standards and these weightages would remain constant throughout the tournament. E.g. If a participant chooses Team India and opponent team as Australia (Australia’s team strength = 10) and match result is WIN (Win =3 Pts) then player’s score becomes 10 x 3 = 30 runs.
17. The score of the Select Participant playing the game on Mobile and PC shall be accumulated every time the Select Participant plays the game and submits the score. Hence the overall score keeps increasing due to accumulated score.
WINNER SELECTION
18. The scores of the contestants, playing online game and playing game over the mobile phone shall be integrated and the top 11 (Eleven) contestants scoring the highest score shall be declared as winners.
19. Hero Honda shall declare the final results on 21st March 2011 on http://www.kricketkakarizma.com
In case of a tie in the scores qualifying for the prize, the following criterion will apply for selecting the 11 winners:
i) Least time taken to reach the particular score;
ii) Least number of matches played to reach the particular score;
iii) Least average of team strengths based on the selection of participant's own teams to play the matches.
20. In the event the tie is not resolved by applying the above criterion the selection would be made by a committee of senior Hero Honda officials using a criterion of their own discretion
21. The decision of choosing the top 11 winners of the contest will be at the sole discretion of HERO HONDA, and that the said decision would be final and binding for all participants.
PRIZE
22. The top 11 winners of the Kricket Ka Karizma contest will be contacted by representatives of Hero Honda on the contact details provided by the winners at the time of registration.
23. Each Winner shall be given a free ticket to watch the ICC Cricket World Cup 2011 final live in Wankhede Stadium, Mumbai and an opportunity to take the victory lap in the stadium during the ICC Cricket World Cup 2011 final match in Mumbai. The category of seats / stands / position in the stadium will be on the basis of availability and at the sole discretion of Hero Honda. Furthermore, each winner shall also be provided boarding, lodging and travel by Hero Honda. The travel can be through rail, road, air, etc as per Hero Honda’s discretion. The winners cannot demand any particular class or mode of transport and / or hotel / accommodation as per individual liking.
24. The winners of this Contest may have to travel a fairly large distance as the ICC Cricket World Cup 2011 finals are scheduled at Mumbai. The to and fro travel will be provided by Hero Honda as per the criteria mentioned below.
1. For areas at a distance of less than or equal to 200 kms from Mumbai, the winner will be provided travel by Bus charges subject to availability.
2. For areas beyond a distance of 201 to 1000 kms from Mumbai will be provided travel charges by 3 tier A/C train subject to availability.
3. For areas beyond a distance 1001 kms from Mumbai will be provided travel by low cost airline subject to availability.
4. In case there is no connectivity/availability from the station from where winner is declared, the eligibility to get the prize will get cancelled.
25. Hero Honda will bear the cost for stay for only 1 (one) day considering hotel check out time of 12 noon. Thereafter, if any winner desires to stay in the hotel for a period beyond 1(One) day, the winner shall have to make his / her own arrangement and bear expenses in respect of the additional days.
26. It is hereby clarified that the winners shall only be entitled to have a victory lap, only once, at the ICC Cricket World Cup 2011 Final Match at Mumbai.
27. It is hereby clarified that all the Winners shall be required to provide proof of identity, age and residency as specified above, to HERO HONDA to qualify for the prize. Identification considered suitable for verification is at the HERO HONDA’s discretion.
28. Prizes are non-transferable, non–substitutable and non-encashable.
29. If at any time during the event or after the event is over, a winner is found to be not complying with the terms and condition, mentioned herein, HERO HONDA reserves the right to cancel the prize and may recover the claimed prize by appropriate legal recourse. In such a scenario the winning entry or the winner will be discarded and a new winner of that prize may be determined. HERO HONDA’s decision is final and no correspondence will be entered into.
30. HERO HONDA may at anytime, at its discretion, change / cancel the prizes mentioned above without prior notice.
LIMITATION OF LIABILITY:
31. HERO HONDA does not accept any responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. HERO HONDA has no control over communications networks or lines and none of them accepts any responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. HERO HONDA is not liable for any consequences of user error including (without limitation) costs incurred.
32. HERO HONDA, reserves the right to, terminate, modify or extend this Contest, at any time at its absolute discretion, without assigning any reason. Decision of HERO HONDA will be final and binding regarding this contest and prizes.
33. HERO HONDA or any of its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this event or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). Without limiting the previous paragraph, HERO HONDA and its associated agencies and companies will not be liable for any damage in transit to prizes.
34. If for any reason any aspect of this event is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of HERO HONDA which corrupts or affects the administration, security, fairness, integrity or proper conduct of this event, HERO HONDA may in its sole discretion cancel, terminate, modify or suspend the event, or invalidate any affected entries.
35. HERO HONDA shall not be liable for any delay in performing, or for failing to perform, any or all of its obligations resulting from any cause beyond its reasonable control in the nature of fire, explosions, natural calamities, State Emergency, riots, etc.
36. HERO HONDA may at anytime, at its discretion, change the prizes mentioned under the he ‘PRIZE’ section without prior notice. The prizes are given subject to applicable taxes and any tax or levy shall be solely to the account of the winner. HERO HONDA accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by the winner.
DISCLAIMER:
37. The communication networks may include interruptions, inconsistencies and errors. HERO HONDA makes no representations and warranties about the suitability, reliability, availability, timeliness, lack of viruses or other harmful components and accuracy of the software used for the purpose of the Contest. The software and related graphics are provided "as is" without warranty of any kind. HERO HONDA hereby disclaims all warranties and conditions with regard to the communication networks or lines and related graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement.
38. HERO HONDA shall not be responsible for unauthorized access to or alteration of contestant’s data, any material or data sent or received or not sent or received, or any transactions entered into through the aforesaid link. Furthermore, HERO HONDA shall not be responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights.
39. In no event shall HERO HONDA be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with participating in the Contest through PC or mobile. There may occur delay or inability to download or play and HERO HONDA expressly disclaims any liability towards the same.
40. HERO HONDA hereby clarifies that it is not the content developer of this game. Therefore, any issues related to the content, usage of application, quality, satisfaction, reliability etc. is not HERO HONDA’s responsibility. Prizes are subject to availability and any difficulty faced by the winners or any related liability related to availability of the prize or any other benefits as mentioned herein is not the liability of HERO HONDA. Furthermore, HERO HONDA disclaims any liability/claim in respect of loss of life, accident, theft etc. that may be suffered by the winners at the World Cup, during their stay in Mumbai or travel thereof.
OBLIGATIONS:
41. The winners must, at the request of HERO HONDA, participate in all evental activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to HERO HONDA using their name and image in evental material.
42. Participating in the Contest constitutes participant's acceptance to the Terms and Conditions of the Contest as specified. All evental materials, including details on how to enter and claim prizes are part of these Terms and Conditions.
43. By participating in the Contest, participant agrees to receive event material about the Contest or any other Contest detail by SMS or email.
44. Unless otherwise indicated, HERO HONDA shall deem the information voluntarily supplied during the course of the Contest and/or personal information provided by the winners as non-confidential, which hereby discharges all obligations of confidentiality. HERO HONDA shall be free to reproduce, use, disclose and distribute the information to third parties without limitation.
GOVERNING LAW AND JURISDICTION:
45. These terms and conditions are governed in accordance with the laws of India. Any dispute shall be subject to the jurisdiction of courts or forums in Delhi, alone.
